Welcome to Nesty SA, a parenting support platform for users in South Africa and beyond. This mobile application (“App”) allows users to join groups, share posts, give advice and connect with others. These Terms and Conditions (“Terms and Conditions”) govern your use of our App and the services related thereto. The App is owned and operated by Nesty Proprietary Limited (“Nesty”, “we”, “us” and “our”).
These Terms and Conditions are binding and enforceable against every person that accesses or uses the App (“you”, “your” or “user”), including without limitation each user who uses the App or registers as contemplated below (“registered user”). By using the App, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

Access to the App is authenticated through a one-time Personal Identification Number (“PIN”) sent to your registered email address each time you log in. You are responsible for ensuring that your email account remains secure and accessible for this purpose.

The views and opinions expressed by users do not reflect those of Nesty or its team. Nesty is not responsible for any advice, comments, or group discussions shared by users.
Users may share personal experiences and opinions relating to products, services, professionals, or establishments (including but not limited to restaurants, schools, medical practitioners, or childcare providers). Such statements reflect the individual’s personal experience and viewpoint only. They do not represent Nesty’s endorsement, verification, or opinion.
While Nesty reserves the right to review and remove content that violates these Terms and Conditions, including defamatory, abusive, or unlawful material, Nesty cannot control or censor individual users’ subjective experiences or opinions expressed in good faith. Accordingly, Nesty shall not be held liable for any statements made by users regarding third-party products, services, or entities, nor for any reputational or commercial impact that may arise from such content.
Nesty provides tools to manage your personal experience within the App but cannot guarantee that all users will share the same opinions, tone, or sensitivities. Use of blocking and reporting features is recommended where needed.
Nesty respects your privacy and will take all reasonable measures to protect it, as detailed in our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
Security Disclaimer
While Nesty employs reasonable technical and organisational measures to protect user data, no system is entirely immune to risk. Users acknowledge that transmission of information via the internet is done at their own risk. Nesty shall not be liable for unauthorised access, disclosure, loss, or alteration of data beyond its reasonable control.
Users may delete their accounts at any time through the App or by contacting Nesty at info@nesty.co.za. Upon deletion, personal data will be securely removed from active systems, except where retention is required by law or for legitimate business purposes.
Anonymised or aggregated content may remain visible to preserve community discussions.
We are committed to ensuring the safety of children and vulnerable individuals on our platform. We enforce a zero-tolerance policy against child sexual abuse, exploitation, and any form of grooming or predatory behaviour.

The information shared within Nesty is for peer support and informational purposes only. Nesty does not endorse any specific parenting approach, product, or medical opinion shared by users. Always consult a qualified professional regarding medical, psychological, or legal concerns.
The Nesty App is intended for use by adults aged 18 and over. Parents and guardians are responsible for ensuring that minors do not access or use the App.
Some features of the App may be made available for a fee. All pricing, renewal, and refund terms will be clearly disclosed before purchase. Payments will be processed through secure third-party providers, and Nesty will not store users’ financial information.
The contents of the App, including but not limited to text, graphics, layouts, trademarks, and software, are protected by law. The App Content is the property of Nesty or its licensors. You may not reproduce or distribute any App Content without prior written consent.
Branding and Intellectual Property
All trademarks, logos, graphics, and designs associated with Nesty are the property of Nesty Proprietary Limited. No person may copy, imitate, or use these without prior written consent from Nesty.
Your use of the App is entirely at your own risk. Nesty disclaims, to the fullest extent allowed by law, all liability for any damage, loss, or expenses, whether direct, indirect, or consequential, arising out of your use of or reliance on the App or its content. Nesty does not warrant that the App is free of viruses, spyware, or harmful code.
By using this App, You agree to defend, indemnify and hold harmless Nesty, its creators, affiliates, licensors, service providers, and their respective directors, officers, employees, contractors, agents, and representatives (“Nesty Parties”) from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from or relating to:
(a) your access to or use of the App;
(b) any content, data, or materials you upload, post, or share through the App;
(c) your violation of these Terms, any applicable law, or any rights of a third party (including intellectual property or privacy rights); or
(d) any interaction or dispute between you and another user or third party.
You acknowledge that your use of Nesty is at your own risk.
This indemnity shall survive termination of your account, your use of the App, or these Terms.
We will use reasonable endeavours to maintain the availability of the App, except during scheduled maintenance periods, and are entitled to discontinue providing the App or any part thereof with or without notice to you.
Nesty may suspend or terminate access if misuse or fraud is suspected. Nesty accepts no responsibility for any resulting liability.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. By using the App, you consent to the jurisdiction of the South African courts regarding any proceedings arising from these Terms and Conditions.

All notices must be in English and sent via hand, courier, or email. Notices by hand or courier are deemed received on delivery; notices by email are deemed received on the date indicated in the “read receipt”.
Nesty may, in its sole discretion, at any time and for any reason, and without prior written notice, suspend or terminate the operation of the App or any user’s right to use it.
You may not assign or transfer your rights under these Terms.
Any failure by Nesty to enforce a right does not constitute a waiver.
If any term is declared invalid, the remaining terms remain in force.
These Terms and Conditions constitute the entire agreement between you and Nesty.
